Mapiz, Inc., a Delaware corporation doing business as Silcoo ("we," "us," "our," "Mapiz," or "Silcoo"), provides Silcoo, a platform for content creators ("Creators") to offer premium digital content to their supporters ("Buyers") through subscription and direct purchase (the "Service"). Silcoo is offered to you conditioned on your acceptance without modification of this Privacy Policy.

This Privacy Policy goes hand-in-hand with our Terms of Use and Content Policy, which govern all use of the Service. Please read them together.

Mapiz, Inc. (d/b/a Silcoo) is the responsible party and data controller regarding Personal Information collected through our Service.

2. Privacy Statement

This Privacy Policy explains how we collect, use, maintain and disclose your information. This includes information that could be used to identify a specific User ("Personal Information"), and other information that does not constitute Personal Information ("Non-Personal Information") that is collected from you while using our Service. We take the privacy of your Personal Information seriously. All employees of Mapiz, Inc. who have access to your Personal Information are required to follow this policy, as amended.

3. Consent

When you use our Service or allow someone to use our Service on your behalf, you consent to our collection, use, disclosure, transfer and storage/retention of any Personal and Non-Personal Information or other information received by us as a result of your use, all in accordance with this Privacy Policy.

4. A Note About Children

Silcoo is intended solely for users who are at least 18 years of age. We do not permit anyone under 18 to use the Service. We do not knowingly collect Personal Information from anyone under 18. If you believe a person under 18 has provided Personal Information to Silcoo, please contact us at [email protected] and we will take steps to delete such information and terminate the associated account. We are not liable for any damages that may result from a user's misrepresentation of age.

5. The Information We Collect

5.1 Categories of Personal Information

The Service collects information that personally identifies you ("Personal Information"). Personal Information includes but is not limited to:

  1. Contact data: your name, email address, phone number, and mailing address;
  2. Identity verification data: government-issued ID documents, selfie images, date of birth, and verification results (collected for sellers as part of our identity verification process);
  3. Demographic data: your gender, date of birth, and location;
  4. Financial data: payment information used to transact on the platform, bank account or payment details for receiving earnings;
  5. Content and activity data: content you upload, transaction records, subscription information, and communications through the Service;
  6. Technical data: IP addresses, device identifiers, browser type and version, operating system, access logs, and clickstream data;
  7. Tax information: for Creators, Social Security Number or Employer Identification Number, Country of Citizenship, Foreign Tax Identification Number, and/or Nonprofit Registration Number, as applicable.

All retention periods may be extended by active legal holds, law enforcement preservation requests, or as otherwise required by law. After the applicable retention period, data is deleted from active databases but may persist in encrypted backups for an additional 30 days.

You may request deletion of your Personal Information at any time, subject to legal retention obligations, by contacting [email protected].

8. Information Shared with Creators

When you become a Buyer of a Creator, you agree to share the following information with that Creator:

  1. Your name and email address, and other profile information you've provided;
  2. Any messages you send to the Creator through the Service;
  3. Your physical address, city, state, and country;
  4. All information about your subscription, including the amount and start date; and
  5. Certain aggregated and anonymized data about how you use Silcoo that cannot be linked back to you or any individual user.

9. When We Disclose Information

9.1 Service Providers

We may share information with companies that perform business-related functions for us, including marketing agencies, database service providers, payment processors, backup and disaster recovery providers, and email service providers. These companies are contractually required to protect your data and may not use your Personal Information for other purposes.

9.2 Corporate Restructuring

We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. If another company acquires our company, business, or assets, that company will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

9.3 Legal Requirements

We may disclose your information where we reasonably believe disclosure is necessary to:

  1. Comply with applicable law, regulation, or legal process;
  2. Respond to lawful requests by public authorities, including law enforcement;
  3. Enforce our Terms of Use and investigate potential violations;
  4. Protect our rights, property, or personal safety or those of another user or any member of the public;
  5. Detect and prevent fraud, security issues, or technical problems; or
  6. Respond to an emergency involving danger of death or serious physical injury.

9.4 No Sale of Personal Information

Silcoo does not sell, trade, or rent your Personal Information to third parties for their marketing purposes. We do not make your Personal Information available to third parties for their marketing purposes without your consent.

10. Safety & Security of Personal Information

10.1 Data Protection

We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. We also require you to enter a password to access your Account information. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we use reasonable efforts to protect your Personal Information, we cannot guarantee its absolute security.

10.2 Third Party Security

We require contractual data protection obligations from all service providers who process Personal Information on our behalf. However, we are not responsible for the privacy or security practices of any third party beyond our contractual requirements. The collection and use of your information by third parties may be subject to their own privacy and security policies.

10.3 Unauthorized Access

If you suspect any misuse, loss of, or unauthorized access to your Personal Information, please let us know immediately at [email protected].

11. Data Breach Notification

If we become aware of a security breach that results in unauthorized access to, or disclosure of, your Personal Information, we will:

  1. Notify applicable regulatory authorities within 72 hours of becoming aware of the breach, where required by GDPR or applicable law;
  2. Notify affected users without unreasonable delay and in no event later than 60 days after discovery of the breach;
  3. Provide affected users with a description of the breach, the types of information involved, the steps we are taking in response, and recommendations for protective measures.

Notification may be delayed if law enforcement determines that notification would impede a criminal investigation, in which case notification will be provided as soon as law enforcement determines it will not compromise the investigation.

12.1 Service Announcements

On rare occasions it is necessary to send out service-related announcements, such as maintenance notifications. Generally, users may not opt out of these communications, though they can deactivate their account. These communications are not promotional in nature.

We communicate with users on a regular basis to provide requested services and regarding issues relating to their Account.

13. Your Choices Regarding Information

13.1 Email Communications

When you receive marketing communications from us, you may opt out by following the unsubscribe instructions provided in the email or by contacting us directly. Despite your email preferences, we may send you service-related communications, including notices of updates to our Terms of Use or Privacy Policy.

13.2 Cookies

You can instruct your browser to stop accepting cookies or to prompt you before accepting a cookie. If you do not accept cookies, you may not be able to use all portions or functionality of the Service.

13.3 Changing or Deleting Your Personal Information

You may change your Personal Information by editing your profile within your Account or by emailing us at [email protected]. You may request deletion of your Personal Information, and we will use commercially reasonable efforts to honor your request. Please note that we may be required to retain certain information for legal compliance purposes (see Section 7 — Data Retention). When we delete information, it will be deleted from the active database but may remain in encrypted backups.

14. California Privacy Rights (CCPA)

14.1 Your Rights

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):

  1. Right to Know: You may request the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties we share with.
  2. Right to Delete: You may request deletion of your Personal Information, subject to certain legal exceptions.
  3. Right to Correct: You may request correction of inaccurate Personal Information.
  4. Right to Opt-Out of Sale/Sharing: Silcoo does not sell your Personal Information. We do not share your Personal Information for cross-context behavioral advertising.
  5. Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

14.3 Exercising Your Rights

14.4 California Shine the Light

California Civil Code §1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share consumer personal information with third parties for marketing purposes without consent.

15. European Users (GDPR)

15.1 Lawful Bases

Data protection law in Europe requires a "lawful basis" for collecting and retaining personal information from citizens or residents of the European Economic Area. Our lawful bases include:

  1. Performing our contract: We need your Personal Information to deliver the Services, enable Creators to establish and display their content, and enable Buyers to find and purchase content.
  2. Legal compliance: Tax laws and applicable record-keeping requirements require us to retain certain records.
  3. Legitimate interests: We use identity, device, and location information to prevent fraud and abuse and to keep the Services secure. We may also send promotional communications about our Services, subject to your right to opt out.
  4. Consent: For marketing communications and certain data processing activities where consent is required.

15.2 Your GDPR Rights

If you are a citizen or resident of the European Economic Area, you have the right to:

  1. Access your personal data;
  2. Correct or rectify inaccurate personal data;
  3. Restrict or oppose the processing of personal data;
  4. Erase or delete your personal data;

15.3 International Data Transfers

If you are accessing the Service from outside the United States, please be aware that your information may be transferred to, stored in, and processed in the United States. We implement appropriate safeguards for international data transfers, including Standard Contractual Clauses (SCCs) where applicable. Privacy laws in the United States may differ from those in your country. By using the Service, you consent to the transfer of your information to the United States.

Subject to applicable law, if you are a citizen or resident of the European Economic Area, you have the right to object to Silcoo's use of your personal information and to lodge a complaint with your local data protection authority.

16. Third Party Links

Our Service may contain links to third party sites. We do not exercise control over third party websites and are not responsible for their privacy practices. These other websites may place their own cookies or other files on your computer. We encourage you to read the privacy policies of the other websites you visit. This Privacy Policy does not apply to information collected on external websites.

17. Public Forums

Silcoo may feature public forums where users can share information and support one another. Any information (including Personal Information) you share in any online forum is by design open to the public and is not private. You should think carefully before posting any Personal Information in any public forum. If you mistakenly post Personal Information and would like it removed, contact us at [email protected]. In some cases, we may not be able to remove your Personal Information.

18. Phishing

If you receive an email or correspondence requesting that you provide sensitive information (including your password or credit card information) via email or to a website that does not seem to be affiliated with Silcoo, or that otherwise seems suspicious, please do not provide such information and report such request to us at [email protected].

19. How to Update Information

Your information can be updated by you in the App. For any questions or issues, please contact us at [email protected]. It is your responsibility to provide us with accurate and truthful information. We cannot be liable for any information that is provided to us that is incorrect.

  1. If you have a complaint about our handling of your Personal Information, address your complaint in writing to [email protected].
  2. If we have a dispute over handling of your Personal Information, we will first attempt to resolve the issue directly between us.
  3. If we become aware of any unauthorized access to your Personal Information, we will inform you in accordance with our Data Breach Notification procedures (Section 11).

21. Changes to This Policy

If we change this Privacy Policy, we will post updates on the Service or App. Modifications are effective thirty (30) days following the "Last Updated" date, or the date communicated in any other notice to you. Please review this policy periodically for changes. By continuing to use our Service after the effective date of any Modifications, you accept those Modifications. If any Modification is not acceptable to you, you should cease using the Service.
